And the court is probably happy to hear that because it means they only have to consider ruling against this regime as a mere formality. They won’t actually impact the agenda. Not that Thomas and Alito care, but Roberts cares about optics.

I love the idea of this - but really, naaaah. These guys MIGHT 'fear' losing some of their station and power. That's it. They have no fear of actual consequences or retribution, and they're all so rich that losing their jobs in a 'blue wave' is basically fucking meaningless. They have absolutely no fear of anything legitimately BAD happening to them.
 
SCOTUS is ending Trump's tariffs. Question now is how the administration will respond.


That "Section 122" he's referring to limits tariffs to a 15% maximum for up to 150 days. That still limits him from the reason he most likely wants to do this which is probably so he can feel like he's wheeling and dealing so it eliminates all of those reactionary punishment tariffs he's been doing. He can probably use that clause up to 15% since we have a trade imbalance with most nations and that's one of the explicitly listed reasons he can use them.

If he actually thinks the tariffs are sound policy he's got right around one full year's worth of hold on Congress to get them through. Seems unlikely given that most moderate and deficit-hawk Republicans hate tariffs and there will be plenty of holdouts.
 
Yeah, but he'll impose 100% tariffs, say it's Section 122 and make people challenge him in court - which will take another year.

Trump's lawyers have already tried to do that in the current case so this decision will most likely decide that already. Whether or not he complies and anyone does anything about it if he doesn't is a different Constitutional crisis.

I don't think he has the votes for it. The rats could jump ship at any point, especially after yesterday's election results. Though, if Mike Johnson is to be believed (he's not, he's a pathological liar), Republicans believe these results were isolated to blue states.

The only recourse I'm aware of is impeachment, and it's impossible to imagine that happening within the next year. Even if there's a blue tsunami next November and he's still defying a Supreme Court decision I can't see them both impeaching him and tossing him out of office as a penalty even though they'd be clearly justified in doing so.
 
It’s important to remember that this court is willing to enable Trump. They didn’t just hear about this issue for the first time today and yet at not point did they place a stay on Trump’s tariffs despite the fact that most seem to find them illegal. They can and likely will rule against them, but they could let the cycle restart in another way and nothing is fundamentally changed. We shall see, but hopefully their dislike for taxes is enough to not only strike them down but also prevent other tariffs from taking effect in another manner until arguments can be heard there. It was pretty god damn rich to hear Barrett bloviate over the government having to refund tariffs already collected and how difficult that will be like, no shit, that’s why you should have stepped in and prevented this from happening on day one.
